Accordingly, we (“we” and “Emovid” mean Emovid Corporation, a Washington corporation), have developed this Policy in order for you to understand how we collect, use, communicate and disclose personal information. This Privacy Policy explains data collection and use practices of the Emovid.com website and any sub-sites (the “Website”); this Policy does not apply to the practices of other online or offline websites, products or services. By accessing the Website, you, the visitor, are consenting to the information collection and use practices described in this Privacy Policy. This Privacy Policy is part of Emovid’s Terms of Use.
1. Collection of Your Personal Information
We may collect certain information about your visit, such as the name of the Internet service provider and the Internet Protocol (IP) address through which you access the Internet; the date and time you access our Website; the pages that you access while at the Website and the Internet address of the website from which you linked directly to the Website. This usage information helps improve the Website, analyze trends, and administer the Website.
We provide you a service that allows you to send a video (Emovid video) to other people, either directly or through a video reply. In order to provide you that service, we may need your name, email address, your social login handle (Google, Facebook, Apple, etc.) and/or other required or optional profile data (which may change over time). You will also be recording a video of yourself to be sent to others. We may change that video in various ways (adding imaging filters, changing lighting, trimming content) either at your direction or automatically via our artificial intelligence (AI) technologies. Some of our AI imaging technologies may require you to upload an image or video of yourself that will be used purely to morph or modify a recording, and we will also store those images or videos in our system. We encrypt that information in transit and potentially in storage depending on your service tier. We will also use the content of your Emovid video in order to transmit it.
If you are a recipient of one or more Emovid videos, we may have received your email address from the sender. We will store these messages and your e-mail so that you can view the videos without creating an account with us, and we will send a notice to your email address and how to view them. You are free, of course, to establish your own account with us. If you use the same email address to create your account, those previously received Emovid videos will be available for you through our Website. If you choose not to create an account and wish us to delete your data (email address, name if we have it), please send an email to support@emovid.com.
To fulfill your requirements, we will send your Emovid video to those you request us to send it, or give access, to. We do not have any control over what these recipients may do with that video (for example taking screen shots of it or otherwise copying information from the video).
2. Use of Your Personal Information
Third party services. The personal information collected on this Website will be used to operate the Website and to provide the services or carry out the transactions you have requested or authorized. Emovid may hire other companies to provide services on our behalf, and we may provide such companies with the personal information they need to perform their duties. If we do, they will be subject to requirements to keep any such information confidential and to only use such information to provide their services to us.
Improved Website Experience. Emovid may use personal information to provide you with more effective service, to improve the Website and our services, and to make the Website easier to use by eliminating the need for you to repeatedly enter the same information. In order to offer you a more consistent experience in your interactions with Emovid, information collected by the Website may be combined with information collected by Emovid from other sources.
Selling of data. We will not sell your personally identifying information without your explicit opt-in consent. We may, however, sell anonymized and aggregated data relating to usage (some examples of such data are the total number of users and the number of messages sent per day/week/month).
Legal Disclosure. Emovid may disclose personal information if required to do so by law or in the good faith belief that such action is necessary to (a) conform to the edicts of the law or comply with legal process served on Emovid; (b) protect and defend the rights or property of Emovid or its affiliates; or (c) act in urgent circumstances to protect the personal safety of Emovid employees or agents, users of Emovid products or services, or members of the public.
As stated in the Terms of Use, you, or the entity you work for or are associated with, owns the Emovid video(s) you create. We will only look at the content of an Emovid video under very specific circumstances as defined in the Statement of Use. You may request us to delete a video; however, we will retain a log of sent videos containing information relating to sending of the video that would include the email address from which it was sent, recipient email, and time of sending. We may institute an automatic deletion policy (for example, deleting a free acount after a defined period or after a specific number of videos have been sent). We may also institute a video expiration option, which would allow the sender to specify that a video automatically deletes after a specified number of days or weeks. Neither of these would affect the log of sent video information described above.
Geographical Transfer. Personal information collected on the Website may be stored and processed in the United States or any country in which Emovid or its affiliates or agents maintain facilities, and by using the Website you consent to any such transfer of information to another country.
3. Control of Your Personal Information
Emovid may send out periodic e-mails to you with information on our products or services. You will be given the option to unsubscribe from these mailings. In addition, we may request your permission to use specific Emovid videos you created in our marketing. We will only do so with your explicit consent to that use.
4. Data Security
Emovid will use commercially reasonable efforts to protect your personal information from unauthorized access, use, or disclosure. However, due to computer hackers, electronic malfunctions, and other events, Emovid cannot guarantee that such safeguards will always protect such information. Furthermore, we do not control what recipients of your Emovid video(s) do with your information.
5. Information Received from Cookies and Third Parties
Storing cookies. We may use cookies on this Website to enhance your user experience. A cookie is a small text file that is placed on your hard disk by a webpage server. One of the primary purposes of cookies is to provide a convenience feature to save you time. For example, if you navigate within a website, a cookie helps the website to recall your specific information on subsequent visits. This simplifies the process of delivering relevant content, eases website navigation, and so on.
Browser Setting. You have the ability to accept or decline cookies. Most Internet browsers automatically accept cookies, but you can usually modify your browser settings to decline cookies if you prefer. If you choose to decline cookies, you may not be able to fully experience the features of this or other websites you visit.
Partners. Emovid collects your information from third parties to facilitate activities and transactions for the operation of the Website and its services, to improve your Website user experiences, and to further Emovid’s mission. Examples of such third parties are Google (using Google Analytics) or Amplitude (using their analytics tools).
We may use this information as a tool to compile anonymized and aggregated statistics about the Website usage, such as how many visitors clicked on key elements (such as links or graphics) on a webpage. We may share such Website statistics with partner companies.
6. Referral Service and Third Party Information
If you choose to use our referral service to tell a friend about our Website, we will ask you for your friend’s name and email address. We will automatically send your friend a one-time email inviting him or her to visit the Website. Your friend may contact us at support@emovid.com to request that we remove this information from our database.
7. Special Notice about Children and Minors
No child under the age of 16 should submit any personal information to us. Children may only use this service in conjunction with a parent or guardian. If you wish to use our service, you must provide approval from your parent or guardian in a way that allows us to verify that it is actually your parent or guardian approving your use. If we discover that a user is under 16 and has not provided such consent, we will delete that user’s account and all related information and content.
8. Special notice for residents of certain states
Your rights. Depending on your location or state of residence, you may have the statutory right to request the following with regard to your information:
- Access to, or a copy of, your information
- Confirmation that we are processing your information
- Correction or amendment of your information
- Deletion of your information
- Transfer of your information to a third party, where technically feasible
- Restriction or objection to certain uses of your information
As provided in applicable law, you also have the right to not be discriminated against for exercising your rights. We cannot provide you our services if you withdraw your consent to our processing. However, you may withdraw your consent to our sale of your information at any time.
Please note that under applicable law, certain information may be exempt from the requests above. For example, we may not be able to alter or delete certain information if we are required to retain it to fulfill our obligations to you, for security reasons, to comply with applicable law, for internal business purposes, or for other valid legal reasons.
We need to verify your identity before responding to a request, which will include confirming your email address. If we are unable to verify your identity, we may not be able to process your request. If you designate an authorized agent to submit requests on your behalf pursuant to applicable law, in order for us to verify the authorized agent, you must provide the authorized agent with signed, written permission to make such requests or a power of attorney. We may follow up with you to verify your identity before processing the authorized agent’s request. If you have a password protected account with us, we will verify your identify through that account. If you do not have a password-protected account with us, we will ask you to supply at least three pieces of personal information and sign a declaration under penalty of perjury that you are the consumer whose personal information is being requested. If you are requesting deletion of personal information, we will confirm for a final time that you would like to delete your personal information.
For further information regarding your legal rights or to exercise any of them, please email us at support@emovid.com and explain the type of request you want to make and the information about which you are making the request. You may also be able to exercise certain choices – like updating your information – through your account.
Depending on applicable law, you may have the right to appeal our decision to deny your request, if applicable. In such situations, if we deny your request, we will provide you with information on how to appeal the decision.
9. Changes to this Privacy Policy
We may update this Privacy Policy from time to time. We encourage you to periodically review this Privacy Policy to stay informed about our practices. Your continued use of the Website after a Privacy Policy change constitutes your agreement to the revised Privacy Policy.

Information for European Union or UK residents
If you are a citizen, or resident, of a European Union country or of the United Kingdom, certain disclosures are required by their respective versions of the General Data Protection Regulation (GDPR). These disclosures are generally provided above in our Privacy Policy or the disclosures in the section for California residents. The chart in the California section also provides a column discussing the legal basis for processing the relevant data as provided in the respective GDPR.
You should also be aware of the fact, as stated in the Privacy Policy, that Emovid is a US company, with no offices in other countries. Data you share is received in the US and subject to US law.
This Privacy Policy is written for the user of Emovid’s services. You may be a recipient of an Emovid video in another country. We store the videos, including your email address. At a minimum, therefore, we will have your email address. If the content of the videos refers to specific personal information of yours, then we will have that as well. However, we may not easily be able to determine whether that is the case, unless specific information about the video (date, sender) is provided to us.
